All bidders must register the day of the auction with Name, Address and Phone Number in order to place a bid. Upon successful completion of a bidder number and obtaining a bidding information packet, bidder agrees to accept the Terms & Conditions of the Auction. Phone Bids and Absentee Proxy Bids will be accepted with completion of required documents. The Auctioneer is in control of the auction and any announcements made the day of the auction will take precedence over printed matter!
Auction format: Round 1: All tracts will be offered on a choice lot basis. Once bidding has stalled, the successful high bidder will have choice of any and or all Lots available for sale, and that Lot/Lots will be placed on hold and the second choice thru seventh choice will be conducted. We will break for 5 to 10 minutes and proceed with Round 2 starting with the first lot/lots chosen in Round 1 and will continue in the order in which the Lots were chosen. At the end of Round 2 we will determine if a 3rd Round is needed. If a Third and final Round is needed, the sale order will be the same as Round 2. Once all bids have been presented to Auctioneers, The Mitchell City Council will be notified of all bids and a Special Meeting will be held in Council Chambers to determine the Sale or No Sale of each individual Tract. If the Tract is accepted, a Purchase Agreement will be signed by successful Bidder and an Earnest Money Deposit of 15% will be made payable to Dean Edwards Trust Account. If the Tract is Not Accepted, Auctioneers will call a No Sale on that particular Lot and we will reach out to the high bidder to see if a Negotiation of Price can be achieved and presented to the City Council. If no agreement is met, that Lot will remain un-sold and will be open to Offers by the Public.
TERMS: A 15% non-refundable earnest money deposit along with a signed Purchase Agreement is required the day of the auction. No contingency for financing will be accepted. Possession at closing on or before November 16, 2023. 2024 Taxes and beyond will be the responsibility of the Buyer. Title Insurance will be 100% of Buyer Expense. Closing Service Fees will be divided equally between Sellers & Buyers with closing to be held at Davison County Title, Mitchell, SD. Cash at Closing. Information on this property was obtained from the Davison County governmental offices & is deemed reliable but is not guaranteed by the Sellers or Dean/Edwards Real Estate & Auction, who are representing the Sellers only in this transaction. Sellers retain the right to reject any and/or all offers. Sold subject to Seller confirmation. No warranty is being made or implied as to the property boundaries, soil productivity, water supply, or environmental hazards, if any. Accommodations for phone bidding / Proxy Bidding may be made by talking with Auctioneers prior to the auction and a $2,500.00 Earnest Money Deposit made payable to Dean Edwards Trust Account must be in our possession prior to bidding. If bidder is successful, the balance of Earnest Money Deposit will be delivered within the day of sale or by arrangements and all paperwork signed.
